By accessing or using Evals.sh ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, including visitors, registered users, and API consumers.

To access most features, you must create an account. You agree to provide accurate, current, and complete information. You agree not to:

• Submit content that violates any applicable law, including intellectual property laws.
• Submit malicious code, malware, or content designed to harm the Service or other users.
• Attempt to reverse-engineer, decompile, or extract the underlying AI models or systems.
• Use automated scripts or bots to abuse the Service beyond permitted API usage limits.
• Resell or sublicense access to the Service without written permission.
• Submit personally identifiable information of third parties without their consent.

5. Subscription and Billing

The Service offers a free tier with limited monthly credits and paid subscription plans. Paid plans are billed on a monthly basis. Subscription fees are non-refundable except as required by applicable law. We reserve the right to modify pricing with 30 days' notice.

6. Intellectual Property

You retain ownership of all content you submit to the Service. By submitting content, you grant us a limited, non-exclusive, worldwide license to process and analyze that content solely for the purpose of providing the Service. We do not claim ownership of your code, files, or evaluation results.

The Evals.sh platform, including its design, software, and AI pipeline, is our proprietary property protected by applicable intellectual property laws.

7. AI-Generated Results

Results produced by the Service are generated by AI models and are provided for informational purposes only. We do not guarantee the accuracy, completeness, or fitness for any particular purpose of AI-generated evaluations. You are solely responsible for decisions made based on Service output.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EVALS.SH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may terminate your account at any time by contacting [email protected].

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Evals.sh operates, without regard to its conflict of law provisions.

12. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
